NASHVILLE, Tenn. - Stacy Case has been working on a special WASTE WATCH report about legislative per diem - the money lawmakers get for hotels and food. Watch it Wednesday at 9pm on FOX17 NEWS.

Every time you buy something....

(corporate graphic) A little over 9 cents of every dollar... goes back into state coffers.

And every year, __?? a half million  (double checking figure) ____  of that is doled out to your state legislators

and hotels.  A legislative perk known as  "per diem."

is a Christiana factory worker and she's outspoken on the per diem issue.

Mendez says:  (under video)  **** 4:46:40  They need to be taking them a baloney sandwich from their own house.  4;46:43

  (corporate graphic)   Our Waste Watch research shows at $173 dollars a day ---  Tennessee's is the second  highest per diem rate in the country--- behind only Alaska--- and tied with Georgia.

Ben says: (front view 01:01:00) **** It is a windfall for some legislators and it shouldn't be.

  Even legislators who live close to the capitol and sleep in their own beds at night....  still get it.

Stacy Case asks: 1:11:04  If you live in Madison,  you shouldn't be getting the per diem daily?
Ben Cunningham answers: ****(front view 1;07:54)   That's right.  If you live close to the capitol and you're taking that full per diem rate,  you're obviously making money where you shouldn't be making money.  (front view sot ends 1;08:02)

  But Nashville resident Senator Thelma Harper took the per diem to the tune of $25 thousand dollars last year--- one of the highest.   (show Stacy at her office)  She didn't want to talk about it.

  But..  Murfreesboro Representative Bill Ketron did....

Bill Ketron says: 7:40:34   I agree if I'm not staying in a motel then I shoudln't be paid for it.

  But Ketron's per diem last year was (bring figure on screen)  $15 grand. 

Stacy: 7:44:56 If you had it to do over again,  do you think you would have given the money back?
Bill Ketron says:  I never thought about that.. but probably so.

   But Ketron rightly points out costly civic commitments that come with the job.

7:43:58 I give some of it back to charity. Going to the heart ball the education ball. Everything you're required to write checks for you actually go in the hole.  7:44:26

  Legislators automatically get that $173 if they're present for roll call.

 It's state law.  They can't refuse it, but they can return it.

Stacy asks:  7:56:37 Do you take it here locally?
7:56;38 I have as you know given back per diem although I have not given back every bit of per diem that I've received. So I don't think generally speaking that I need per diem if I'm right here in town, but I don't speak for anyone but myself.

   We checked Representative Mike Stewart's per diem spread sheet.  He didn't return it in 2009 and  (have to double check 2011 when system is back up)  2011. But returned most of it in 2010.  For 2012, his (bring $11 grand on screen)  total was $11 grand.  The lawyer and Desert Storm veteran's per diem is still lower than many others who live locally.

 Still others, turn in for 'extra'  per diem on days they (show office work on spread sheet )  do "office work" like Representative Sherry Jones, of Nashville, whose per diem (bring figure on screen)  totaled $19 thousand in 2012.

Stacy: You feel like it's part of the salary?
Sherry It is part of the salary.  It's in the code. It is by law. 7:53:59

   (bring pic and figure on screen for each in a creative way) Representative Brenda Gilmore of Nashville lives 10  miles from the Capitol and earned $17 grand in 2012 per diem.  Senator Jack Johnson of Brentwood..  $12 thousand. Dickson Senator Jim Summerville -- $15 grand.  And the list goes on... keeping it is the norm.

Stacy asks: 1;00:18   There have been efforts to reform this in the past and it just can't seem to get enough traction.. Why?

Nat: political

   Elections in fact have been won or lost on this issue. That's how pharmacist Ferrell Haile got elected.

Senator Ferrell Haile/ (R) Gallatin 4:18;37 Two things I promised.  One was I would no longer accept any per diem for lodging. The second was the first bill I would file would be addressing the per diem issue.

Nat:  hotel 

  Haile has introduced legislation that would cut out hotel expenses for legislators living within 50 miles of the capitol.
 But our Waste Watch research found many states doing better --- and going further.

  Hawaii for example, pays commuting legislators $150 a day.  Non commuters who live close to the capitol get just $10 a day.  And Michigan has cut out abuse by capping per diem at the flat rate of $10 grand a year.

Ben Cunningham/ Tn Tax Revolt 1;10:35 (front view  1:07:16  ) There's so much technology available now for debit cards and automatic tracking of expenses apps on your phone.  There are all kinds of ways to track your expenses and when people are directly compensated for their direct expenses that's fine.  Nobody has a problem with that. 1:10:48 (1:07:30 front view)
