Edward Mays sits frustrated in the Dickson County Jail.

"I can't do nothing about anything right now," said Mays. "I can't go down there and pick out the flowers or her last little dress."

His daughter, Somara Smith, was killed yesterday, the apparent victim of a crime with more questions than answers.

The TBI believes smith somehow suffered internal injuries at the home of her mother's boyfriend Edward Benesch who then dropped the child off at her family's home.

Smith's mother was in jail at the time on a charge of failing to pay child support.

Benesch is charged with reckless homicide and child abuse in the toddler's death.

It's that part that weighs heavily on Mays.

"I just knew of somethings I've been told that the person is like, different stuff I knew about him that weren't good at all," said Mays.

Mays says those worries intensified when Somara's mother went to jail and he knew Edward Benesch would be spending more time with his three children.

Mays says he wrote the Department of Children's Services about it and called them three times but never heard anything.

"DCS probably could've prevented this from happening if they did their job," said Mays.

The Department says Mays isn't telling the whole story though.

Children's Services claims that letter was addressed to one of the father's other children who's in state custody and that letter only said "Daddy Loves You."

As for those phone calls, DCS says there was only one and it left no information about Edward Benesch.

DCS says its staff tried to contact Mays about the call but he never called them back.

Body found in Percy Priest Lake

SMYRNA, Tenn. (AP) -- Authorities say a body has been found in Percy Priest Lake in Middle Tennessee.

WSMV-TV (http://bit.ly/16gYKys) reports officials with Metro Police, the Office of Emergency Management and Tennessee Wildlife Resources Agency were at the scene Saturday at Hole In The Wall Island. The body was reported to authorities about 11 a.m.

TWRA officials say they believe the deceased man is a boater who disappeared in the lake two weeks ago.

Police said the agencies coordinated with each other to get a boat in the water and recover the body.
