Inspectors gave the Islamic Center of Murfreesboro's new mosque a passing grade and a temporary occupancy permit.
"I can not believe myself that we got it finally. It's a victory not just for Islamic Center. I think it's a victory for our Constitution," said board member Essam Fathy.
For awhile it looked like the mosque may remain empty.
In June Chancellor Robert Corlew threw the building's permit saying Rutherford County failed to give the public adequate notice before approving it.
Then in July Corlew declined the County's request to issue an occupancy permit.
A Federal Judge over-ruled Corlew's decision and ordered the County to allow the ICM to apply for a permit after the Islamic Center and the US Attorney filed suit.
The attorney for the group that initially sued to stop construction of the mosque released this statement on the granting of a temporary occupancy permit.
"It's a sad day in the history of Rutherford County when the Department of Justice and the Rutherford County can sanction a violation of Tennessee State Law," said Joe Brandon.
The Islamic Center still has a few improvements to make before the permit is made official including adding decorative plants and finishing the parking lot.
Members are planning to hold their first prayer in the new Mosque Friday at 1 PM.
Fathy says that's important as it falls during the Islamic Holy month of Ramadan.
"I think it means something for every Muslim in this community that we were able to make it that time," said Fathy.

Former Dyer County constable sentenced to prison

DYERSBURG, Tenn. (AP) -- Former Dyer County Constable Derick Shane Hundley has been sentenced to 25 years in federal prison.
The State Gazette (http://bit.ly/14UHydd ) reported Hundley was sentenced Monday after earlier entering a guilty plea to enticement of a minor through electronic means. The government dropped a child pornography count.
Prosecutors said Hundley, who is 30, used a cellphone to try to entice a minor female to have sex with him. Police arrested Hundley last July and found an external hard drive that contained numerous images of minors involved in sex. He resigned from the constable post he had won in 2010 after his arrest.
