Man's Murder Defense: Blacked-out Drunk

Stream WZTV Fox 17 Newscasts LIVE starting with Fox 17 This Morning at 5am and News at 9pm.

SAN DIEGO, Ca. -- A man accused of murder says he shouldn't have to answer for his crime, because he was blacked-out drunk.

Higinio Salgado is charged with beating his boss to death last April. A court psychiatrist is backing the San Diego man's story, saying his estimated BAC of .24 made him virtually unconscious.

Prosecutors argue blacked-out or not, Salgado still made the decision, and a man's murder cannot be excused because someone over-indulged in drinking.

This case in now in the hands of the jury.
