EXCLUSIVE: State Wants Defense Attorney Removed From Vandy Rape Case ; California Suspects Could Get a Deal - Erika Lathon

Stream Fox 17 newscasts LIVE starting with Fox 17 This Morning at 5 am and News at 9 pm.

Prosecutors have filed a motion that could get California Attorney, Albert Perez Jr. thrown off the case. Perez is one of four lawyers representing Brandon Vandenburg in the Vanderbilt rape case. Vandenburg is one of four former Vandy football players accused of sexually assaulting an unconscious female co-ed in a dorm room this summer. District Attorney, Tom Thurman has filed a motion to have Perez disqualified. According to court records obtained by Fox 17 News, Perez is accused of destruction or the attempted destruction of evidence. The state calls him an un-indicted co-conspirator whose involvement with the case is a conflict of interest for Vandenburg. The D.A.'s Office has struck a deal with two California men who are also accused of tampering with evidence. Miles Finley and Joseph Quinzio have agreed to testify about Perez's alleged involvement with destroying evidence. In exchange for their testimony, the state will consider dropping the charges against Finley and Quinzio. Both men are from California and are former friends of Vandenburg. In a separate development, another defendant, Cory Batey wants to remove a court ordered ankle monitor. Of the four men chaged in the Vanderbilt rape case, Batey is the only one ordered to wear and pay a monthly for an ankle monitor. Batey is from Nashville. Brandon Vandenburg and two other defendants, Brandon Banks and Jaborian McKenzie have been free to travel back and fourth to their home states. Fox 17 News has also learned that the report on DNA evidence in the case should be completed sometime this month.
