Attorneys in Vanderbilt Rape Case Brace for Legal Showdown

NASHVILLE, Tenn. - The state wants defense attorney Albert Perez thrown off the Vanderbilt rape case for allegedly destroying evidence. Perez is one of Brandon Vandenburg's attorneys. Perez has requested a hearing tomorrow that could force the state to prove its case against him and FOX17's Erika Lathon has learned Vandenburg could be called to testify. Brandon Vandenburg is one of 4 former Vanderbilt football players accused of raping an unconscious co-ed inside Gillette Hall. Ahead of the August trial, a mini court drama is playing out with Vandenburg's legal team and the state. It started when District Attorney General Tom Thurman asked that California attorney Robert Perez be disqualified. Prosecutors filed motions claiming Perez destroyed evidence and is an unindicted co-conspirator. Defense attorneys fired back.

Filing their own motion, they requested a hearing so prosecutors could prove the allegations against Perez. Wednesday it may be Brandon Vandenburg in the role of representing his attorney. He's expected to testify about what, if anything, he knows about evidence tampering and destruction. Tomorrow's hearing is set for 1pm tomorrow afternoon at the AA Birch building.
