Report: Tenn. Drunken Driving Law Has Loophole -- Erika Lathon

NASHVILLE, Tenn. -- MADD says a so called loophole in the state sentencing law should be closed. An investigation by the Memphis Commercial Appeal Newspaper found at least three cases where people convicted of vehicular homicide served less time in jail than those convicted of driving under the influence. MADD State Program Director, Kate Ritchie says more work needs to be done in regard to sentencing laws on vehicular homicide. Under current state law, a DUI conviction carries a mandatory 48 hours in jail. If you kill someone while driving drunk there is no mandatory jail time. The sentencing is left up to a judge who has the option of suspending the sentence in lieu of probation.
